2. Eligibility and Service Requirements

To use our Service, you must:

Be at least eighteen (18) years of age.
Reside in a jurisdiction where we legally operate and can deliver products.
Agree to provide truthful, accurate, and complete information, including all health information required for your order.

You acknowledge that you are personally responsible for ensuring your use of the Service and the medication complies with the advice of your healthcare provider and all applicable laws.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the absolute confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Given the sensitive nature of the Service, maintaining account security is critical.

4. Orders and Payment

a. Order Acceptance

Your placement of an order is an offer to purchase the product(s). We may accept or reject your offer in our sole discretion. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities, inaccuracies in product or pricing information, or issues identified with payment.

b. Payment

You agree to pay all charges incurred by you or on your behalf through the Service, at the prices in effect when such charges are incurred. You authorize us (and our third-party payment processor, e.g., Stripe) to charge your designated payment method for the total amount of your order, including any applicable taxes and shipping fees.

c. User Information

You agree to provide current, complete, and accurate purchase and account information for all orders. This includes your email address, shipping address and payment method.

5. Shipping and Delivery

We will arrange for the shipment of the products to you. Delivery will be made to the address you specify. We will use discreet packaging to protect your privacy. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

6. Returns and Refunds Policy

Due to federal and state laws, and for the safety of all, we CANNOT accept returns of medication. All sales are final.

If your order arrives damaged, incorrect, or is lost in transit, please contact us immediately at [email protected] so we can investigate and determine the appropriate remedy.

7. User Conduct and Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that could harm us, our partners, or any third party. You are prohibited from:

Providing any false, fraudulent, or inaccurate information.
Violating any applicable international, federal, state, or local laws or regulations.
Infringing upon our intellectual property rights or the rights of others.
Attempting to bypass, "hack," or compromise any security features of the Service.
Using the Service to obtain medication for anyone other than yourself, unless legally authorized as a caregiver.

All content on this Site, including text, graphics, logos, images, and software, is the property of PrEP Delivery (or PrEP Delivery B.V.) or its licensors and is protected by copyright, trademark, and other intellectual property laws.

10. Disclaimer of Warranties

THE SERVICE AND ALL INFORMATION, CONTENT, AND PRODUCTS MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE, OR THE INFORMATION, CONTENT, OR PRODUCTS INCLUDED.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PREP DELIVERY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR PHARMACY PARTNERS BE LIABLE FOR:

ANY SIDE EFFECTS, ADVERSE REACTIONS, HEALTH COMPLICATIONS, OR INEFFECTIVENESS OF THE MEDICATION. YOUR EXCLUSIVE REMEDY FOR ANY PRODUCT CLAIM IS WITH THE MANUFACTURER OF THE PRODUCT.
ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE.
ANY DAMAGES RESULTING FROM YOUR RELIANCE ON ANY INFORMATION OR MEDICAL ADVICE PROVIDED (OR NOT PROVIDED) BY THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT(S) IN QUESTION.

12. Indemnification

You agree to defend, indemnify, and hold harmless PrEP Delivery and its affiliates, officers, directors, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your improper use of the Service, or your violation of any law or the rights of a third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Netherlands, without regard to its conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall be resolved exclusively through binding arbitration in Eindhoven, rather than in court.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
